​Steps to Take After a Car Accident

If you have been injured in a car accident, you need to take steps to protect your legal rights. Even minor injuries such as whiplash, can impact your life. You do not yet know whether your injuries will cause chronic pain, interfere with your ability to work, or require long-term medical care.   • Step 1 — Call the police. A responding officer will generally prepare a police report after interviewing the drivers and evaluating the scene. Insurance companies look for this.
  • Step 2 — Be honest when answering the officer's questions. If you are hurt, describe your injuries. The police report is a helpful resource because it summarizes basic facts. Favorable fact patterns may also facilitate settlement negotiations between your attorney and the other driver's insurance company.
  • Step 3 — Seek medical treatment. You will need a medical professional to fully assess the scope of your injuries and your projected recovery.
  • Step 4 — Find an attorney. You don't know exactly what's going to happen, but dealing with the aftermath of a car accident on your own will be overwhelming. An attorney can advise you of your options, while being mindful of the statute of limitations.
  • Step 5 — Do not give any statements to the other driver's insurance company. If they approach you, refer them to your attorney. Any statements you make could be taken out of context and possibly used against you in subsequent legal proceedings, as admissions against interest. The same rule of silence applies to posting on social media.
